These Terms govern access to and use of the Our Power App. The application is provided by Our Power App LLC, a company registered in Wyoming, United States.
1. Acceptance of the Terms
By creating an account, purchasing a subscription, or using the application, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the application.
2. Age
The application is intended for adult users. You must be at least 18 years old to use the application independently.
3. Account
You must provide current information, keep your sign-in credentials confidential, and not give other people access to your account. You are responsible for activity performed through your account.
4. Purpose of the Application
The application provides learning materials, exercises, speaking tasks, transcription, feedback, audio, and other features for learning English. We do not guarantee that you will achieve a particular language level or result within a specific period.
5. Artificial Intelligence
Some features use artificial intelligence and automated speech and text processing. Transcriptions, corrections, assessments, translations, personalized lessons, and recommendations may contain errors and are provided as learning assistance, not professional advice. Independently verify important information.
Before a recording is sent to external providers, the application requests separate, explicit consent. Consent remains in effect until withdrawn or until an updated notice must be accepted. Refusing consent does not prevent access to features that do not require voice recording. Processing, retention, and consent withdrawal are described in the Privacy Policy.
6. Subscriptions and Payments
Some features may require a paid subscription. The price, billing period, and applicable conditions are displayed before payment.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. When you purchase a subscription, your contract of sale is with Paddle, and Paddle's own terms apply to that transaction in addition to these Terms. Applicable VAT, GST or sales tax is calculated at checkout based on your billing country and is collected and remitted by Paddle.
If you select an automatically renewing subscription, it renews until cancelled. Cancellation stops future renewals; access continues through the paid period unless applicable law requires otherwise.
7. Trial Period
We may provide a free trial. Its duration and available features are shown in the application. If a trial is not linked to a previously selected paid plan, no automatic charge occurs when it ends. If you separately select an automatically renewing paid subscription, future billing terms are shown before payment confirmation.
8. Refunds
Refund requests are considered under applicable law, the conditions of the particular purchase, and the rules of the payment provider. Our voluntary money-back guarantee and the procedure for requesting a refund are set out in the Refund Policy, which forms part of these Terms.
9. Acceptable Use
You may not use the application for unlawful activity, gain unauthorized access, interfere with the service, bypass restrictions, scrape data at scale, violate another person's rights, or request dangerous, fraudulent, discriminatory, sexually exploitative, or otherwise prohibited content. We may block such requests and provide a way to report problematic AI content.
10. Intellectual Property
The application, software, design, learning materials, text, audio, graphics, and other materials belong to Our Power App LLC or are lawfully used by it. You receive a limited right to use the application for personal learning.
11. User Content
You retain rights in content you create or upload, including voice recordings and answers. You authorize us to process it as necessary to provide, secure, and improve the application features in accordance with the Privacy Policy.
12. Service Availability
We may change, update, suspend, or discontinue individual features. We do not guarantee uninterrupted operation without errors, delays, or technical downtime.
13. Termination of Access
We may restrict or terminate access for a material breach of these Terms, fraud, a security threat, or where required by law. You may delete your account and stop using the application at any time under Settings → Privacy → Delete account.
14. Limitation of Liability
To the extent permitted by law, the application is provided “as is” and “as available.” Our Power App LLC is not liable for indirect or consequential loss, except where liability cannot be excluded by law.
15. Third-Party Services
The application may use Amazon Web Services, OpenAI, ElevenLabs, and Paddle. Their own terms and policies may apply to the relevant services.
16. Changes to the Terms
We may update these Terms. The current version is published on this page with a new effective date.
17. Governing Law
To the extent permitted by applicable law, these Terms are governed by the laws of Wyoming, USA. Mandatory consumer rights under the law of your country of residence remain unaffected where applicable.
